These Terms of Service (the “Terms”) govern your access to and use of Three Rivers Vacation Rentals (the “Site”) and any reservation you make through it. The Site is operated by Vivo Unlimited, LLC (“Host”, “we”, “us”), a California limited liability company located in Three Rivers, CA. By using the Site or completing a booking you agree to these Terms; if you do not agree, do not use the Site.
1. The booking contract
Each reservation is a short-term lodging contract between you (the “Guest”) and the Host for the property, dates, and guest count shown on your confirmation email. Rates, fees, and the cancellation policy in effect at booking apply to the entire stay. We may decline or cancel any reservation at our discretion if a listing becomes unavailable, the booking violates these Terms, or we reasonably believe the booking is fraudulent.
2. Payments & fees
Total charged at booking includes the nightly rate × nights, the per-listing cleaning fee, and 10% Tulare County Transient Occupancy Tax. Payment is processed by Stripe (cards, Apple Pay, Google Pay) or made directly to the Host via Zelle, depending on the option you select at checkout. Card information is never stored on our servers.
3. Cancellations & refunds
Our default policy is “moderate”: full refund 5+ days before check-in, 50% refund within 5 days of check-in, no refund within 24 hours of check-in. The full Cancellation Policy lives at /cancellation and is incorporated into these Terms by reference. Refunds are issued to the original payment method and typically appear within 5–10 business days.
4. House rules
Each listing’s detail page contains the house rules for that property — check-in / check-out times, quiet hours, occupancy caps, smoking, pets, and party / event policy. Material violations may result in same-day removal without refund. The Host’s decision on damages, lost-key fees, and excess-cleaning is final.
5. Liability & assumption of risk
Three Rivers and Sequoia National Park involve real outdoor risks: swift cold rivers, wildlife, fire, falling rocks, weather, limited cell service, and remote roads. By booking you assume responsibility for your own safety and for supervising minors and animals in your party. To the maximum extent permitted by California law, the Host’s aggregate liability arising out of any stay is limited to the total amount you paid for that booking.
6. Indemnification
You agree to indemnify and hold harmless Vivo Unlimited, LLC, its members, employees, and contractors from any claim arising out of your use of a property, your violation of these Terms, or your violation of any law. This includes attorneys’ fees reasonably incurred.
7. Privacy
Our handling of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.
8. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Tulare County, California, and you consent to personal jurisdiction there.
9. Changes
We may update these Terms from time to time. The effective date at the top reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance.
